Council Worker versus Workcover Versus Community Centre
The claimant, who was employed by a council, alleged that she attended the Community Centre to perform ground maintenance during the course of her employment with the council. As she was crossing a grassy area to turn the sprinklers on at the site, her foot went down a large hole.
Even though the property was owned by the council, it was deemed that the lesser (the Community Centre), had a liability as occupier of the building. As such, the centre was found liable for a percentage of the total claim settlement.
